Due to the nature of digital data products, once a purchase is completed and lead data is delivered, the transaction is final and non-refundable. By completing a purchase, you acknowledge and agree that you have read, understood, and accepted this no-refund policy. This policy exists because digital data cannot be "returned" once delivered—you will have already received and can use the complete dataset.

1. Agreement to Terms

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service. Your use of the Service constitutes your acceptance of and agreement to all of the terms and conditions contained herein.

2. Description of Service

HOA Board Leads provides access to contact information for HOA (Homeowners Association) and COA (Condominium Association) board members in the State of Florida. This data is compiled from publicly available records obtained from the Florida Division of Corporations.

3. Nature of Digital Data Products

You acknowledge and understand that:

The data provided consists of publicly available information from government records
Data accuracy depends on the accuracy of source records filed with the Florida Division of Corporations
Contact information may change after records are filed with the state
We do not guarantee the accuracy, completeness, or currentness of any data
Data is provided "as-is" without warranty of any kind
Once delivered, digital data cannot be "returned" or "undelivered"

4. Refund Policy — ALL SALES FINAL

ALL SALES ARE FINAL AND NON-REFUNDABLE.

Due to the nature of digital data products, we maintain a strict no-refund policy:

Once payment is processed and data is delivered, the sale is complete and final
No refunds will be issued for any reason, including but not limited to:
- Dissatisfaction with data quality or accuracy
- Inability to use or access the data
- Duplicate purchases (you are responsible for reviewing before purchase)
- Change of mind or business circumstances
- Technical issues on your end
- Claims that the data did not meet your expectations
- Failure to download within the provided timeframe
By completing a purchase, you expressly waive any right to a refund, chargeback, or payment dispute
Chargebacks or payment disputes will be vigorously contested with all available evidence and may result in:
- Immediate termination of any download access
- Collection proceedings for the disputed amount plus fees
- Legal action to recover damages
- Reporting to credit agencies and fraud databases

YOU MUST CONFIRM YOUR ACCEPTANCE OF THIS NO-REFUND POLICY BEFORE COMPLETING ANY PURCHASE.

5. Purchase Process and Delivery

When you make a purchase:

You will see the exact number of leads and total price before checkout
You must confirm your acceptance of these Terms and the no-refund policy before payment
You will receive an email with a download link immediately after payment
Download links are valid for 7 days and limited to 5 downloads
Data is delivered in CSV format compatible with Excel and Google Sheets
You are solely responsible for downloading and saving your data within the provided timeframe
Failure to download does not entitle you to a refund

6. Acceptable Use

You agree to use the data only for lawful purposes. Prohibited uses include:

Any use that violates federal, state, or local laws, including CAN-SPAM, TCPA, and Do Not Call regulations
Harassment, abuse, or sending threatening communications
Reselling, redistributing, or sublicensing the data to third parties
Using the data for any illegal, fraudulent, or deceptive purposes
Scraping, data mining, or automated extraction of our website content
Sharing your download link or purchased data with others

7. Intellectual Property

The Service and its original content (excluding data derived from public records), features, and functionality are and will remain the exclusive property of HOA Board Leads. The data compilation, organization, selection criteria, and delivery method are proprietary. You receive a license to use the data you purchase for your own business purposes only.

8. Disclaimer of Warranties

THE SERVICE AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, RELIABILITY, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

The data will be accurate, complete, current, or error-free
The Service will be uninterrupted, secure, or error-free
The results obtained from using the Service will meet your requirements or expectations
Any errors in the Service or data will be corrected
The data will be suitable for any particular purpose

9. Limitation of Liability

IN NO EVENT SHALL HOA BOARD LEADS, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, BUSINESS OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your access to or use of (or inability to access or use) the Service
Any conduct or content of any third party
Any data obtained from the Service
Unauthorized access, use, or alteration of your transmissions or content
Any reliance placed on the data provided

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC TRANSACTION GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to defend, indemnify, and hold harmless HOA Board Leads and its licensees, licensors, employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any privacy or intellectual property right; or (d) any claim that your use of the data caused damage to a third party.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Florida for the resolution of any disputes.

12. Dispute Resolution and Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Florida. You waive your right to participate in a class action lawsuit or class-wide arbitration.

13. Severability

If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

15. Entire Agreement

These Terms constitute the entire agreement between you and HOA Board Leads regarding the use of the Service, superseding any prior agreements between you and HOA Board Leads relating to the Service.
